RIVERS 2019: Supreme Court Drops APC’s Stay of Execution Order

The stay of execution order that was recently granted to the All Progressives Congress in Rivers State may hold no water as the supreme court has upheld the judgement of Justice Chiwendu Nworgu on the congresses conducted by the party in the state.

The court went on to declare that the legal representative of the party in the state is the lawyer of the Magnus Abe led faction in contrast to that of the Tonye Cole led faction.

You may recall that, on February 4, 2019, a Court of Appeal sitting in Port – Harcourt declared a stay (pend) on the execution that had earlier been granted, nullifying all Primary conducted by the All Progressive Congress in the State which implied that INEC should not recognize the APC candidates for elections.

Judge Presiding over the matter, Justice Mohammed Mustapha said the stay was  was warranted due to the the complexity of appeals on the ruling.

With this latest judgement by the supreme court, the appeal of Ibrahim Umar and twenty-two other aggrieved members of the APC have been upheld thereby making impotent the stay of execution order that was previously delivered.

You may also recall that the aggrieved members of the party claim that they were not allowed to participate in the party’s congresses which were conducted in the state.

Prompting them to drag the party affairs to court.
